Acknowledgement of Risks and assumption of full responsibility.
The Participant acknowledges that such risks include, but are not limited to, drowning, falling, colliding with the shore or lake bed, lake side trees/vegetation, weed or submerged or floating objects/debris/anchor ropes, presence of insects, bacteria, algae, fish and amoebas in the water, becoming entangled in ropes or handles, buoys, and other obstacles, being struck by other participants, equipment injuries, trip and slip hazards on the land, pontoon and grassed area (it should be acknowledged that most surfaces, and particularly the pontoon and their access ways will be wet) and the potential for contracting illnesses from water borne viruses etc.. In that regard the Participant fully acknowledges that the lake water is not of drinking quality. It is a n atural ecosystem containing bacteria and the Participant acknowledges that there is potential for experiencing illness if the water is consumed. Participants are advised to spit out any lake water that enters the mouth .
The Participant further acknowledges that the lake is a natural environment that can be very deep in places and shallow in others. The Participant is expected to appreciate the great risks involved with these activities and the participant assumes and bears full responsibility and liability for any death, bodily injury, illness or other losses or property damage occurring on at the Facility or from the use of the facilities that are sustained by the Participant.
The Participant also acknowledges that they are fully aware that severe social and economic loss may result from the actions/inactions of the Participant and fellow participants while engaged in the activity/activities and agrees to bear full responsibility therefor, including full responsibility for injuries caused by them but sustained by other participants.
The Participant hereby fully and irrevocably indemnifies the Operators in respect of any damage sustained at the facility and caused by their own negligence or recklessness.
Certification of Ability and Physical Condition to Participate Under Control.
The Participant warrants that he or she is above the stipulated minimum age and height and is a competent swimmer who can swim 50m in a buoyancy aid and helmet; that the participant will behave in a responsible and non-reckless manner at all times and be mindful of their own physical condition and abilities.
The Participant warrants that he or she has carefully inspected and is familiar with the facilities, finds them safe and suitable for the Participants purposes. If found, the Participant must report immediately any unsafe or defective equipment or facilities to the Operators.
Participants who have any of the following disorders should not attend and will receive a full refund, known back/neck Injuries, Diabetes, Epilepsy, Respiratory, Pulmonary, history of dislocations, Psychological or other health conditions affecting a participant’s performance. Any Medical conditions must be advised to staff prior to participation.
Covenant not to Sue and Agreement to indemnify the Operators.
